Protecting your personal data is of great importance to us. For this reason, we process your data exclusively in compliance with the statutory provisions (GDPR, Telecommunications Act 2003). This information on data protection explains the most important aspects of data processing within the framework of our website.

Contacting us

When you contact us using the designated form on our website or by email, the data you submit will be saved for a period of six months for the purposes of processing your enquiry and any follow-up questions. We will not transmit these data without your consent.

Data storage

Please note that for the purpose of online bidding and for the subsequent processing of contracts, so-called cookies are used to store the IP data of the subscriber, as well as the buyer’s name and address. The data provided by you are required solely for the fulfilment of a contract or in order to carry out pre-contractual measures. We do not transfer data to third parties except for the transmission of detailed information about payment processing (method of payment, amount payable, transaction ID) to the processing bank institute/payment service provider for the purposes of debiting the purchase price, to the transport firm/shipping firm contracted by us to deliver the merchandise, and to our tax consultant in order to fulfil our obligations with regard to tax law.

When you participate in our online auctions and bid in real time, your data (bids and their link to your data) will be stored after the conclusion of the online auction by our external partner Motrada, which supplies the auction house with the online-bidding platform.

If you, as an online bidder, wish to exercise your right to have your data deleted, we will immediately pass on your request to Motrada. This firm will undertake the deletion, providing the storage of the data is not required for the fulfilment of legal or contractual obligations or there are other good causes for its retention.

In the case of a contract, all data from the contractual relationship are stored until the expiry of the retention period stipulated by law or necessitated by comprehensive legal defence/legal prosecution. Data processing takes place on the basis of the statutory provisions of § 96 (3) TKG, Art. 6 para. 1 lit a (consent), and lit b (necessary for fulfilment of the contract) of the GDPR, as well as legitimate interests pursuant to Art. 6 para 1 of the GDPR. The latter are indicated not least by the contractual relationship between the contractual partners; prevailing (conflicting) interests of the affected party do not exist.

Our website uses so-called cookies. Cookies are small text files that are stored on your device by the browser. They do not cause any damage. We use cookies to ensure that our website design is user-friendly. Some cookies remain stored on your device until deleted by you. Web-Analyse

It uses cookies that make it possible to analyse your use of the website. The information about your use of the website generated by the cookie is generally transmitted to a Google server in the USA and saved there. You can change the settings of your browser software to keep the cookies from being saved. We have entered into an appropriate data processing agreement with our external provider.

The relationship to the web analytics provider is based on the EU-US Privacy Shield. The data are processed on the basis of the statutory provisions of § 96 (3) TKG (Telecommunications Act) and Art. 6 Sec. 1 lit. a (consent) and/or f (legitimate interest) of the General Data Protection Regulation. Our concern in accordance with GDPR (legitimate interest) is the improvement of our offers and our website. In terms of the DSVGO (legitimate interest), our intention is to improve our offering and our website. Since our customers’ privacy is important to us, user data are pseudonymised. User data will be kept for the duration of 38 months.

Please note that Google has a browser add-on for disabling Google Analytics, giving you more control over which data are collected by Google Analytics.

Newsletter

You can subscribe to our newsletter via our website. For this, we need your email address and your statement that you consent to receive the newsletter.

In order to provide you with information in a targeted manner, we also collect and process details you voluntarily supply regarding areas of interest, your birthday, and your postal code.

As soon as you register for the newsletter, we will send you a confirmation email with a link to confirm the registration.

You can cancel your newsletter subscription at any time. Just send your cancellation request to the following email address: auctioninfo@imkinsky.com. We will immediately delete all your data in conjunction with the newsletter subscription.

Your rights

In principle, you have the right to information, correction, deletion, restriction, data portability, revocation, and objection. If you believe that the processing of your data violates a data protection law or your data protection rights have otherwise been violated, you can file a complaint with the supervisory authority. In Austria, this is the Datenschutzbehörde (DSB).
